General Conditions of Combined Trips and 1-day Excursions Contract

For the purposes of these general conditions, the program/brochure is the document with the description of the combined trip/1-day excursion, the information of which is part of this contract to the extent applicable. Its format may be printed: general brochure, circular, information sheets, etc., or on the web: www.happytours.es. The information about the program is binding on Happy Erasmus or the retailer, unless any of the following circumstances apply:
1. That the changes in said information have been clearly communicated in writing to the traveler before the contract is concluded and such possibility has been expressly mentioned in the program-offer.
2. That subsequent modifications occur, subject to prior written agreement between the contracting parties.

Standard information form for package travel contracts


1. Legal regulation applicable to the combined travel/1-day excursion contract and acceptance of the general conditions.
These general conditions are subject to the provisions of the consolidated text of the general law for the defense of consumers and users, approved by DECREE 101/2018, of July 27, of the Consell, which approves the Regulations for travel agencies of the Valencian Community. [2018/7667], which regulates travel agencies and reservation centers.


These general conditions form an integral part of the contract along with the particular conditions agreed upon therein or that appear in the travel documentation provided simultaneously with the signing of the contract.

2. Organization
The organization and execution of this combined trip/ 1-day excursion is carried out by INTERNATIONAL EXCHANGE STUDENTS SERVICES, S.L. - commercial name Happy Erasmus, (hereinafter Happy Erasmus), cif: B98939986, with address at C/ Ramon Llull, 21 Bajo Derecho, 46021 Valencia, Spain, Tourism License: Cv-Mm1796-V.

3. Price
The price of the combined trip/1-day excursion has been calculated based on the exchange rates, transportation rates, fuel costs and fees and taxes applicable on the date of publication of the program, or subsequent ones, if applicable, have been made public.

Any increase in the aforementioned elements may lead to a review of the final price of the trip, in the strict amounts of the aforementioned price variations. The upward price revision may be made no later than 20 calendar days before the start of the combined trip/1-day excursion. These modifications will be notified to the traveler in a clear and understandable manner, with a justification for this increase.

If the mentioned price increase exceeds eight percent of the total price of the combined trip/1-day excursion, the traveler may, within 48 hours, accept the proposed change or terminate the contract without paying a penalty. In the event that the traveler does not notify his decision within the indicated period, it will be understood that he chooses to terminate the contract without any penalty. In the event of termination by the traveler of the combined trip/1-day excursion contract, all payments made by the traveler will be refunded and, in any case, within a period not exceeding fourteen calendar days from the date of termination of the contract. .

The prices and conditions are not applicable for groups with more than 9 seats, whether made in the same reservation or in several. In these cases, check the prices and conditions for groups, since hotels may also not accept reservations from minors not accompanied by their parents (students, etc.). The hotel may reject the reservation for this reason.

Happy Erasmus reserves the right to modify at any time the prices, itineraries or services included in the stays or circuits that appear in the programs, as a result of possible variations in costs or unforeseen situations. When such causes occur, before confirmation of the services, the traveler may withdraw their request without any penalty, or accept the new price. Confirmation of the requested services, except in special circumstances, will ordinarily be verified within the following approximate deadlines:
- Two business days in Spain
- Three business days in the rest of Europe
- Four business days in the Caribbean.

3.1. The price of the 1-day combined trip/excursion includes:
a) Round trip transportation when this service is included in the contracted program, in the type of transportation, characteristics and category stated in the program or in the documentation delivered to the traveler at the time of subscribing. b) The tourist taxes of hotel establishments (unless otherwise indicated). c) Airport taxes. d) Indirect taxes (VAT, I.G.I.C.) When these are applicable. e) Technical assistance during the trip, when this service is specifically included in the contracted program. f) All other services and complements that are specifically specified in the contracted program. g) Everything that is expressly stated in the contract for the combined trip/1-day excursion/1-day excursion.

3.2. Special offers.
When the combined trip/1-day excursion is contracted as a result of special offers, advertised through circulars or information sheets, at a price different from that expressed in the general brochure, the services will be only those that are specifically detailed in the circular. , even when reference is made to any of the programs described in the brochure, as long as it is made for the exclusive purposes of general information about the destination.

3.3. Exclusions.
a) The price of the 1-day combined trip/excursion does not include: Visas, airport taxes and/or entry and/or exit taxes payable at destination, vaccination certificates, “extras” such as coffees, wines, liquors, waters minerals, special diets - not even in the case of full board or half board, unless otherwise expressly agreed in the contract, washing and ironing of clothes, optional hotel services, and in general, any other service that is not appears expressly in the section “the price of the combined trip/1-day excursion includes” or is not specifically detailed in the program, in the contract or in the documentation that is delivered to the traveler when signing it.
b) Excursions or optional visits within the combined trip/1-day excursion. Excursions or optional visits that are contracted at the destination are not part of the combined trip/1-day excursion contract. Its publication in the brochure is for informational purposes only and its price is expressed as “estimated”. These excursions will be offered to the traveler with their specific conditions and final price independently, and there may have been variations in their costs, services included, etc. That alter the estimated price and the possible realization of the same is not guaranteed until the moment of contracting.
c) Tips. Tips are not included in the price of the combined trip/1-day excursion. In the case of cruises, the tip loses its voluntariness and, at the beginning of the cruise, the client is warned that he must make the commitment to deliver a certain amount at the end of the trip based on the duration. This amount, set before the cruise begins, is intended solely for service personnel.

4. Payment method. Cancellations, registrations, refunds, minimum number of registrations.
In the act of registering the reservation, the agency will require from the traveler the amount necessary to achieve the requested services, based on the conditions established to Happy Erasmus by the service providers, and it must not be less, in any case. , at 40% of the total amount of the trip. Issuing at that time, the corresponding receipt in favor of the traveler, which will specify, in addition to the amount advanced by the traveler, the total price of the combined trip/1-day excursion requested. The remaining amount must be paid at least ten days before the departure date, unless otherwise expressly indicated. If registration is carried out within the deadlines in which the service providers request full disbursement, you must pay the total amount at the time of registration. For justified cause, at the request of the service provider, the payment terms indicated above may be modified, including said modification, the possibility of anticipating the payment date. If the advance payment and/or the total price of the trip is not made under the conditions indicated, it will be understood that the traveler withdraws from the requested trip and the conditions provided for this purpose apply.
In the event that the organizer is seen in the imppossibility of executing the contract due to unavoidable and extraordinary circumstances, the traveler will be notified of cancellation without undue delay before the start of the combined trip/1-day excursion, in such cases, the organizer and, where applicable, the retailer will refund the traveler the all payments made, but will not be responsible for additional compensation.

In cases where Happy Erasmus conditions, and expressly specifies, the viability of the combined trip/1-day excursion offer to having a minimum number of participants, and, if that number is not reached, the trip is cancelled, The user will have the exclusive right to a refund of the total price or advance amounts, without being able to claim any amount as compensation and/or compensation, as long as said cancellation has been communicated in writing to the traveler, at least:
- Twenty calendar days before the start of the combined trip, according to the information contained in the program, in the case of trips lasting more than six days,
- Seven calendar days before the start of the combined trip, according to the information contained in the program, in the case of trips between two and six days in duration,
- Forty-eight hours before the start of the combined trip/1-day excursion, according to the information contained in the program, in the case of trips of less than two days in duration.
All refunds that are applicable for any reason will always be formalized through the retail agency where the registration was made, within a period of no more than fourteen calendar days, and no refund will be made for services not voluntarily used by the traveler.
Special charter flights are subject, in all cases, to the registration of a minimum of 30 seats.

5. Traveler withdrawal

At any time prior to the start of the combined trip/1-day excursion, the traveler may terminate the combined trip/1-day excursion contract, but must pay a penalty to Happy Erasmus for the following concepts:

1 – Management expenses
Management costs per reservation, for total modification or cancellation of the requested services, will be applied depending on the time elapsed since the reservation was registered, according to the following scale.
a) From reserve registration for Europe and North Africa:
Up to 72 hours later. No expenses
From 72 hours and up to 7 calendar days: 30 euros
More than 7 calendar days: 60 euros
b) From registration of reservation for Rest of the World:
Up to 72 hours later. No expenses
From 72 hours and up to 7 calendar days: 60 euros
More than 7 calendar days: 120 euros

2 – Cancellation expenses, if any:
In the event that any of the contracted and canceled services are subject to special economic contracting conditions, such as aircraft charters, ships, special rates, hotels during local fair periods, tickets to shows, etc., the costs will be applied. of cancellation due to withdrawal that may apply, serving as an example, but not limited to, the cases indicated below, (whose percentages are subject to demonstrable variation):
- Airline seats: the issuance of regular line tickets entails 100% of the amount of the air seat as expenses. Cancellation of seats on special flights entails 100% of expenses from 10 days before departure, until the day it occurs.
- Hotel places: with less than 7 days' notice, the total amount of the first one or two nights is charged, depending on specific dates such as Christmas, New Year's Eve, Easter, etc., and some hotels may apply higher penalties. Consult in each case.
- Circuits or cruises: cancellation of these services entails: between 30 and 20 days before departure, 10% of the amount; between 19 and 10 days before departure 20%; between 9 and 5 days before departure 40% and less than 5 days before departure 100%.
- Optional insurance: this service is not voidable, meaning it carries 100% of the total amount from the day it is contracted.

3 – Expenses based on the advance notice of the resolution:
- 25% of the total trip if the withdrawal occurs more than 30 days and less than 15 days before the start date of the trip;
- 50% with more than 14 days and less than 7 days,
- 100% within 6 days prior to departure. Cancellation on the same day, or failure to show up at departure, will not determine the right to any refund of the amount paid (100% expenses).

NOTE: all indicated periods are understood as business days of the trip departure location.

In case of abandonment of the establishment before the contracted date, or voluntary non-use by the traveler of any contracted service, Happy Erasmus will not issue any refund..
The traveler may assign the combined trip/1-day excursion contract to a person who meets all the conditions applicable to that contract. The transfer must be previously communicated to the organizer or, where applicable, to the retailer, on a durable medium, with a reasonable notice of at least seven calendar days before the start of the combined trip/1-day excursion. The assignor of the contract and the assignee will be jointly and severally liable for the amount pending payment of the agreed price, as well as for any commission, surcharge or other additional costs derived from the assignment. The organizer or, where applicable, the retailer will inform the transferor about the actual costs of the transfer.

4 - Withdrawal procedure

To proceed with the withdrawal of any contracted service, the client must follow the following steps:

A) log in with your user on our platform. Each client has their username where they can find all the services purchased with their contract and cancellation conditions, which are also sent in PDF format by email at the time of booking.

B) choose the service you wish to cancel and process the cancellation request. In this section you will see the cancellation policy, its dates and penalty amounts established specifically for the service in question - if any - these amounts depend on the general contracting conditions.

C) the refund of the stipulated amount will be issued in the next 5 business days after the end of the activity.

6. Alterations
Happy Erasmus undertakes to provide its clients with all the contracted services contained in the program that gave rise to the combined travel/1-day excursion contract, with the stipulated conditions and characteristics, all in accordance with the following:
In the event that, before the start of the combined trip/1-day excursion, Happy Erasmus is forced to substantially modify any of the main characteristics of the travel services, is unable to meet any of the special requirements, or proposes to increase the price of the trip by more than eight percent, the traveler may choose between terminating the contract without any penalty or accepting the proposed change. The traveler must communicate the decision made to the retailer, or, where appropriate, to the organizer within three days of being notified of the modification. In the event that the traveler does not notify his decision in the indicated terms, it will be understood that he opts for the termination of the contract without any penalty.
If the transfers/assistance from the airport hotel or vice versa, or other similar ones, included in the offer program, are not fulfilled, mainly for reasons beyond the control of the transfer provider and not attributable to the organizer, the organizer will only refund the amount of the alternative transportation used by the client in the movement, upon presentation of the corresponding receipt or invoice.

7. Obligation of the traveler to report lack of conformity in the execution of the combined trip/1-day excursion.
The traveler Erasmus inform the organizer or, where applicable, the retailer, without undue delay, of any lack of conformity that he or she observes during the execution of a travel service included in the contract. Said communication will preferably be made “on site” to the representative of Happy Tours at the destination as stated in the travel documentation or, otherwise, as soon as possible, in writing or in any other form in which it is recorded, to Happy Erasmus. or to the retailer and, where appropriate, to the provider of the service in question.
In the event that the solutions arbitrated by Happy Erasmus are not satisfactory for the traveler, they will have a period of one month to complain to the retailer.

8. Prescription of actions
Notwithstanding the provisions of the preceding section, the limitation period for actions derived from the rights recognized in the consolidated text of the general law for the defense of consumers and users and other complementary laws will be two years, as established in article 169 of the aforementioned law.

9. Responsibility
The organizers and retailers of combined trips / 1-day excursions will be jointly and severally liable to the traveler for the correct performance of the travel services included in the contract, regardless of whether these services must be executed by themselves or other providers. Whoever responds to the traveler will have the right of repetition against the employer to whom the non-compliance or defective fulfillment of the contract is attributable depending on their respective scope of management of the combined trip/1-day excursion. If any of the services included in the trip are not performed in accordance with the contract, the organizer and, where applicable, the retailer must remedy the lack of conformity, unless it is impossible or if this entails a disproportionate cost, taking into account the severity of the non-conformity and the value of the travel services affected. The traveler will not be entitled to compensation for damages if the organizer or, where applicable, the retailer demonstrates that the lack of conformity is:
a) Attributable to the traveler,
b) Attributable to a third party unrelated to the provision of the contracted services and unpredictable or inevitable
c) Due to unavoidable and extraordinary circumstances.

The organizer and the retailer must provide adequate assistance without undue delay to the traveler in difficulty, especially in the case of unavoidable and extraordinary circumstances, in particular by:
A) the provision of adequate information on health services, local authorities and consular assistance, and
B) assistance to the traveler for thisestablish remote communications and help find alternative travel formulas.

The organizer and, where applicable, the retailer may charge a reasonable surcharge for such assistance if the difficulty has been caused intentionally or due to the traveler's negligence. Under no circumstances will this surcharge exceed the actual costs incurred by the organizer or retailer.
In relation to the right to a reduction in the price and/or compensation for damages in the event of non-execution or incorrect execution of the travel services, the provisions of the current regulations applicable to the matter will apply. Regarding damages that are not physical, these must always be proven by the traveler.

10. Delimitation of the services of the combined trip/1-day excursion.

10.1. Air travel.
Presentation at the airport: for air travel, presentation at the airport will be made at least 90 minutes before the official departure time for domestic flights, 2 hours for flights to other countries in Europe and North Africa, and 3 hours for transcontinental flights. When planning a transfer to the airport, the traveler must take into account the transportation problems, both public and private, that some cities suffer. A direct air journey will always be understood as one whose documentary support is a single flight coupon, regardless of whether the flight makes a technical stop. Happy Erasmus will not be responsible for the loss of air connections or any other means of transportation that have not been contracted as an integral part of the same combined trip/1-day excursion.

10.2 Hotels.
The quality and content of the services provided by the hotel will be determined by the official tourist category, if any, assigned by the competent body of your country. If there is no official classification, information on the hotel category will be provided in the program according to the information obtained from the tourism organizations of the respective countries and the qualification of other organizers. Given the current legislation in this regard, which establishes only the existence of single and double rooms, allowing a third bed to be enabled in some of the latter, it will always be considered that the use of the third bed is done with the knowledge and consent of the people. who occupy the room, and thus the room will be reflected as triple in all the forms or documentation provided to the traveler. The same will occur in cases of double rooms for use by up to four people, reflected as quadruple, where children or third parties will be accommodated in a folding bed, in a sofa bed (if any) or sharing the existing beds.
In some cases there is the possibility of enabling cribs, which must be requested by the clients before the contract is concluded and which, unless expressly mentioned, are not included in the price.
Regardless of the arrival and departure times at the destination, as a general rule, hotel rooms are available from 2:00 p.m. on the day of arrival and must be vacated before 12:00 p.m. on the day of departure.
When the contracted service does not include the transfer and if the traveler anticipates his arrival at the reserved hotel or apartment later than 6:00 p.m., it is necessary to communicate this circumstance as far in advance as possible to Happy Erasmus, the hotel or the apartments directly. , to guarantee accommodation.
Likewise, you must consult the agency, at the time of making the reservation, about the possibility of bringing animals, as they are generally not allowed in hotels and apartments. The hotel accommodation and/or meals service will be understood to be provided as long as said services have been available to the traveler on the corresponding night, regardless of whether, due to the contracted flight schedules or circumstances of the trip, the arrival time and /or departure at the hotel does not allow its use. Not having the right to any refund for it.

10.3 Apartments.
When renting apartments, on some occasions, the corresponding rental contract must be signed on site according to the model adjusted to current urban rental legislation. This contract must be signed by the traveler, who will pay the corresponding deposit or civil liability insurance to respond for possible damages, if required.

10.4 Circuits.
Happy Erasmus informs clients that in the circuits specified in the program, the accommodation service will be provided in any of the establishments listed in the same or in some other of the same category and area and also that the circuit itinerary may be developed according to any of the options described andn the program. In the previous cases, if the traveler accepts said information prior to the conclusion of the contract, this lack of definition will not imply modification of the contract.

10.5 Other services.
In the circuits, the means of transport available can vary in their characteristics depending on the number of participants. Specifically, if a certain number of travelers is not reached on any departure, it is possible that a minibus or “van” will be used which, unless expressly indicated otherwise, do not have reclining seats. Likewise, in the description of each circuit it is indicated whether or not the coach has air conditioning, it being understood that they do not have it if nothing is indicated. Transportation in the natural parks for photographic safaris is carried out by “van” or by all-terrain vehicles characteristic of each country. In all of the above cases, the design, structure, comfort and safety of the transport vehicle may not adapt to Spanish norms and standards, but to those specific to the country of destination of the trip.
When the trip is made in coaches "vans", limousines and similar hired by Happy Erasmus directly or indirectly, in the event of an accident, regardless of the country where it occurs, the traveler must file the pertinent claim against the transport entity in order to to safeguard, where appropriate, its insurance compensation, being assisted and advised free of charge in its efforts by Happy Erasmus.

11. Passports, visas and documentation
All users, without exception (including children), must carry their corresponding personal and family documentation in order, be it a passport or National Identity Document, according to the laws of the country or countries being visited. It will be at their expense when travel requires it, obtaining visas, passports, vaccination certificates, etc. If the granting of visas is rejected by any authority, or your entry into the country is denied due to lack of the required requirements, or due to a defect in the required documentation, or because you are not a carrier of the same, Happy Erasmus declines all responsibility. for events of this nature, any expenses incurred being borne by the traveler, applying in these circumstances the conditions and rules established for cases of voluntary withdrawal of services. All travelers, and especially those with nationality other than Spanish, are also reminded that they must ensure, before starting the trip, that they have met all the applicable rules and requirements regarding visas in order to be able to enter without problems in all the countries that are going to be visited. Minors under 18 years of age must carry written permission signed by their parents or guardians, in anticipation that it may be requested by any authority.

12. Health and safety
Each country is particular when it comes to diseases and health risks. For these purposes, the traveler acknowledges that he or she is solely responsible for analyzing said risks and taking appropriate preventive actions (vaccines, personal protective equipment, etc.). The traveler also acknowledges that they will comply at all times with any measure or protocol imposed by Happy Erasmus, transport companies, airlines and national or international authorities or organizations regarding public health measures and that they renounce taking any action against Happy Tour in relation to to the aforementioned measures and protocols for which the traveler is responsible.

13. Arbitration clause
Happy Erasmus expressly expresses its refusal to submit to the transportation arbitration courts for any issue arising from the existence of this contract. 14. Information that the retail agency must provide to the traveler.
The traveler is informed that at the time of signing the contract they must receive from the retailer the relevant information on the specific documentation necessary for the chosen trip, as well as advice on optional subscription to insurance that covers cancellation and/or cancellation costs. or assistance insurance that covers repatriation costs in the event of an accident, illness or death; and information on the probable risks implicit in the destination and contracted trip, in compliance with the general law for the defense of consumers and users. For these purposes, the traveler is recommended to contact the Ministry of Foreign Affairs, whose information office provides specific recommendations according to destination, through the Internet or by any other means.

15. Other complementary information

15.1 Information about the trip members:
The traveler is obliged to providetruthful information necessary for the provision of the contracted services (number of people without omitting children and/or babies, ages, ID or passport numbers, wedding dates, etc...). Happy Erasmus will not be responsible for possible price differences or non-availability of the contracted services that airlines, hotels or other service providers may require or adopt, due to the conditions required in the program not matching the information provided. by the client, there being no liability for Happy Erasmus for this reason.

15.2 Baggage:
For all purposes and as far as land transport is concerned, it will be understood that the user's luggage and other personal belongings are kept with him, regardless of the part of the vehicle in which they are placed, and that they are transported at the user's expense and risk. . Users are recommended to be present during all loading and unloading of luggage. Regarding air, rail, sea or river transport of luggage, the conditions of the transport companies apply, with the ticket being the binding document between the aforementioned companies and the passenger. In the event of suffering any damage or loss, the traveler must immediately present the appropriate claim to the transport company. Happy Erasmus is committed to providing timely assistance to clients who may be affected by any of these circumstances.

15.3 Photographs and maps.
that are reproduced in the catalog are intended solely to offer greater information to the traveler. In the event that any type of modification occurs in the establishments, this cannot be considered misleading advertising by Happy Erasmus.

15.4 Happy Erasmus.
Happy Erasmus is not responsible for changes in address/ownership/management of the hotels contained in the catalog after its publication, as well as for the repercussions and/or consequent changes that this entails (name, services, category of the establishment, partial closure of the facilities, etc.) Which in any case, will be promptly communicated to the user.

15.5 Happy Erasmus.
Please inform yourself in detail based on the dates of your trip, since at certain times of the year the presence of algae can be observed in the Caribbean Sea.

15.6 Hotels.
Some hotel establishments may require the traveler to present a credit card as a guarantee for payment of extras and/or request the amount of the deposit that could be paid in cash.
Third or fourth people and children sharing a room will usually stay on a sofa bed or extra bed (if any), since in most hotels there are no true triple/quadruple rooms. It should be taken into account that accommodating third and fourth people within the same unit considerably reduces space.
Likewise, an extraordinary tax as a tourist tax may be charged directly to the traveler from the hotel establishment, in accordance with local regulations.
By virtue of Decree Law 1/2020 of January 17, against excessive tourism to improve quality in tourist areas, with entry into force on January 23, 2020, hotel establishments located in the following areas of Mallorca: El Arenal, Playa de Palma and Magalluf and Ibiza: West End of Sant Antoni (Annexes 1, 2, 3 and 4 of the aforementioned regulations) the following measures will apply:
Practices that are dangerous to the life, health and physical integrity of clients are prohibited in tourist accommodation establishments and in homes subject to tourist marketing. In all cases, dangerous practices are considered, among others, moving from one balcony or window to another, or jumping or jumping from unsuitable places into swimming pools, into a vacuum or into any element (the practice of so-called balconying). Customers who carry out such actions must be expelled from the establishment immediately, regardless of the sanctions that may be imposed on them, in accordance with this Decree Law and the corresponding municipal ordinances. The expulsion must be ordered by the management of the establishment or the person selling the property, which may require the collaboration of security forces.
Tourist accommodation establishments can only sell alcoholic beverages individually and at the same price that appears on the price list they have on display. These establishments cannot offer alcoholic beverages included in a global price, except up to a maximum of three units of alcoholic beverage per customer and lunch or dinner service.
The sanctions:
1. Very serious infractions are subject to a penalty between 60,001 and 600,000 euros. 2. Serious infractions are subject to a penalty between6,001 and 60,000 euros. 3. Minor infractions are subject to a penalty between 1,000 and 6,000 euros.
Under certain circumstances of force majeure, it is possible that the provision of hotel services may be altered. Please, before signing the contract, contact Happy Erasmus /or the Hotel to confirm that the hotel services are provided normally.

16. Insurance

19. Transcription errors
